Is Mortgage Legal?

Dear Attorney General Cuomo:

I have been contacted by my constituents regarding improprieties in the mortgage obtained for 26-18 210th Street, in Bayside, Queens, which is held by Emigrant Mortgage Company, Inc.

The documents filed for the mortgage indicate that Kwan Ok Chung and Kyung Jin Chung were purchasing the aforementioned address as a private residence. Further the mortgage specifically states that this property "is or will be improved by only a one or two family residence or dwelling". The problem with this statement is that the property at 26-18 210th Street is being converted into a church, which is a community use facility not a one or two family home.

The neighborhood is unhappy at the prospect of having so many people coming into the neighborhood to use this facility. Therefore I am requesting that your office please investigate the legality of this mortgage.
