Alleged DWI Runs Stop Sign, Hits City Bus

Photo Vinny DuPre A store proprietor and an employee at 33-10 31st Ave. were arrested by police of the 114th Precinct on May 18 for violation of a local law, possession with intent to sell unstamped cigarettes and evasion of payment of cigarette tax after a search warrant was executed under the direct supervision of 114th Precinct Commanding Officer Deputy Inspector Brian McCarthy. Evidence consisting of $91 and untaxed cigarettes was confiscated.
At about 12:55 a.m. on May 19, a 36-year-old white woman, later identified as Erika Kipreos, 46-03 Newtown Rd., Astoria, driving an SUV, was seen disobeying a stop sign at 47th Street and Ditmars Boulevard and, traveling at a high rate of speed, subsequently colliding with a city bus. The operator of the bus and three passengers from the bus were transported to Elmhurst Hospital Center in stable condition. Two passengers were transported to NYU Hospital, also in stable condition. The remaining seven passengers from the bus refused medical attention.

Kipreos exited the vehicle when the car was stopped and was observed to have slurred speech, was unsteady on her feet and had a slight odor of alcohol about her. She was also unable to produce insurance identification. She was also transported to Elmhurst Hospital Center in stable condition and was arrested for DWI. She was charged at the scene by 114th Precinct police with failure to stop at a stop sign and failure to produce proof of insurance as well as for driving while intoxicated.

On Thursday, May 18, two people were arrested for selling cigarettes without a New York state tax stamp. Under the direct supervision of 114th Precinct Commanding Officer Deputy Inspector Brian McCarthy, a search warrant was executed on the ground floor of 33-10 31st Ave. The sale of untaxed cigarettes had been suspected at this location and upon investigation, sufficient probable cause brought about the issuance of the court order on May 17 by Criminal Court Judge Pauline Mullings. A juvenile age 16 and a man age 41 were arrested and charged with violation of a local law, possession with intent to sell unstamped cigarettes and evasion of payment of cigarette tax. Evidence consisting of $91 and untaxed cigarettes was confiscated.

Two separate establishments were closed down for quality of life violations, also by officers of the 114th Police Precinct under McCarthy's direct supervision on Thursday, May 18. A court order was issued to close a store at 38-16 Broadway, which had been subjected to a search warrant in the past that resulted in the seizure of illegally reproduced goods and corresponding arrests. At approximately 6:30 p.m. May 18, under the direct supervision of 114th Precinct Commanding Officer Deputy Inspector Brian McCarthy, the court order was carried out. As had been the case when the search warrant was executed, a 33-year-old Hispanic man, thought to be the proprietor, was observed standing behind the counter, offering counterfeit music compact discs for sale. He was arrested and charged with trademark counterfeiting. Numerous trademark counterfeit compact discs were confiscated.

The second location to be closed by court order was a licensed premise at 21-13 Astoria Blvd. that had failed underage sting operations in the past and had been summonsed for disorderly premises on multiple occasions. Tuesday, May 16:

+ At 22-63 43rd St. a 27-year-old white male was charged with assault and harassment after he hit a female in the face and shoved her into a doorway. The victim sustained a bloody nose and a laceration to the back of her head.

+ A 27-year-old Hispanic man was charged with menacing, assault with intent to cause physical injury, criminal possession of weapon, resisting arrest and disorderly conduct after he was observed at 37th Street and 30th Avenue swinging a yellow stick at two males. The perpetrator fled, resulting in a foot pursuit. The man resisted arrest and a victim stated that the perpetrator threw a can that hit him in the face.

+ A 16-year-old Hispanic man was charged with unlawful possession of marijuana after he was found in possession of marijuana at 47th Street and 31st Avenue.

+ A 52-year-old Hispanic man was charged with assault with intent to cause physical injury after a victim charged the suspect bit the victim's hand at 43rd Street and Broadway.

+ At 43rd Street and Broadway a 54-year-old white man was charged with assault with intent to cause physical injury after he hit a victim in the face, causing a cut to the victim's cheek.

+ A 48-year-old white man was observed disobeying a stop sign at 49th Street and 25th Avenue. When stopped, the defendant was found to have a suspended driver's license. He was charged with aggravated unlicensed operator and traffic device violation.

+ A 19-year-old white man was observed by surveillance cameras removing merchandise from inside 28-56 Steinway St. without paying. He was charged with criminal possession of stolen property, possession of burglars tools and petit larceny.

Wednesday, May 17:

+ A57-year-old white man was observed making an improper left turn into Astoria Boulevard from 43rd Street. The driver was stopped at 45th Street, where he was unable to produce his license. His license was found to be suspended. He was charged with aggravated unlicensed operator, unlicensed operator and illegal signal.

+ A 25-year-old Hispanic man was observed driving without a seatbelt. He was stopped at 23rd Street and 39th Avenue and was unable to produce his license, which was found to be suspended. He was charged with aggravated unlicensed operator, unlicensed operator and driving without a seatbelt.

+ A 41-year-old Hispanic man was observed driving without seatbelt. He was stopped at Northern Boulevard and 46th Street and was found to have no driver's license or proof of registration. He produced a false New Hampshire insurance card. Two other persons were inside the vehicle and a gravity knife was in plain view on the floor. The driver was charged with possession of a forged instrument, operating a vehicle without insurance and registration and unlicensed operator. He and the two passengers were all charged with criminal possession of a weapon.

+ As an officer was issuing a summons to a 28year-old Hispanic woman, she drove away. She was stopped at 28-08 Steinway St., where she claimed she was a Corrections Officer. She pulled out a CO card and stated that this was her shield number but she did not have her ID on her. A Department of Motor Vehicles check revealed her license to be suspended. She was charged with criminal impersonation, aggravated unlicensed operator and unlicensed operator.

+ A 28-year-old Hispanic man was observed by cameras at 35-00 48th St. placing store merchandise in a plastic bag. When a security guard questioned the man, he attempted to flee the scene and punched the guard in the lip. The perpetrator was charged with assault with intent to cause physical injury, criminal possession of stolen property and petit larceny.

+ A32-year-old Hispanic woman was observed at 42-02 Northern Blvd. removing merchandise from store shelves and placing items underneath her jacket. She proceeded to walk past all points of sale without paying. She was charged with criminal possession of stolen property and petit larceny.

+ At 31st Avenue and Steinway Street two 18year-old black males punched a victim in the face. A23-year-old black male hit the victim in the face with his head. All three were charged with assault with intent to cause physical injury.

Thursday, May 18:

+ Two 21-year-old Hispanic males and a 23year-old black male were observed operating/traveling in a vehicle that was reported stolen. The vehicle was stopped at 62-50 30th Ave. and all three were charged with two counts of grand larceny and criminal possession of stolen property

+ A 29-year-old Hispanic man was observed failing to come to a complete stop at a stop sign. He was stopped at 42nd Street and 25th Avenue and was found to have a suspended North Carolina driver's license. He was charged with aggravated unlicensed operator and failure to stop at a stop sign.

+ A21-year-old white man was observed making an illegal left turn from the middle lane at 43rd Street and Astoria Boulevard, causing a hazardous condition. When stopped, he was found to have a suspended driver's license. He was charged with aggravated unlicensed operator and illegal signal.

+ A19-year-old Asian man was observed operating a vehicle with a brake light out and on which no rear license plate was displayed. He was stopped at 31st Street and Astoria Boulevard and was found to have a suspended license. He was charged with aggravated unlicensed operator, equipment violation, license plate violation and unlicensed operator

+ A 43-year-old Hispanic man was arrested at 25-39 44th St. and charged with assault with intent to cause physical injury after a victim stated that the perpetrator punched him repeatedly in the face.

Friday, May 19:

+ A 44-year-old white man was observed parked in a vehicle at 31st Street and Broadway with a crack pipe in public view on the passenger seat. He was charged with criminal possession of a controlled substance.

+ A 42-year-old female showing merchandise for sale on the sidewalk at 32-18 Steinway St. without a valid vending license, on request produced fraudulent identification. She was charged with forgery and violation of a local law.

+ In a verbal dispute at 28-39 36th St., two Hispanic men, 21 and 27 years old, hit a victim on the left elbow with bottles. They were charged with assault with intent to cause physical injury and harassment.

+ A51-year-old Hispanic man was found to be in possession of three box cutters and four knives at 42nd Street and 21st Avenue. He was charged with criminal possession of a weapon.

+ A 64-year-old Hispanic man was observed driving while using a cell phone at 25-46 35th St. He did not have his license with him, and a check revealed his license was suspended. He was charged with aggravated unlicensed operator and unlicensed operator.

+ Although he had previously been issued a notice of trespass forbidding him from entering 22-72 31st St., a 48-year-old white man entered the premises unlawfully, acted disruptive and threw a can at a complainant. When he was arrested, the man attempted to bite officers and walk away. He was charged with resisting arrest, criminal trespass and disorderly conduct.

+ A woman had a dispute with a 21-year-old Hispanic man, who attempted to knock her cell phone out of her hand, causing a laceration to her middle finger. He was arrested at the 114th Police Precinct station house at 34-16 Astoria Blvd. and charged with assault with intent to cause physical injury and harassment.

Saturday, May 20:

+ When a 47-year-old Asian woman was arrested at 23rd Avenue and 29th Street for an open complaint for aggravated harassment, she was found to have a stun gun in her purse. She was charged with aggravated harassment and criminal possession of a weapon.

+ According to the victim, at 42-14 28th Ave. a 39-year-old Hispanic man slapped her all over her body, pulled her hair and struck her in the back with a leather dog strap in front of her two young children. He was charged with assault with intent to cause physical injury, acting in a manner injurious to a child under the age of 17 and harassment.

+ A 26-year-old black man was observed blocking pedestrian traffic, pushing pedestrians, and acting in a threatening manner at 31-70 Steinway St. He was charged with resisting arrest and disorderly conduct.

+ A 19-year-old white man, a 22-year-old Hispanic man, a 29-year-old Asian man and a 20year-old black woman were found in possession of marijuana cigarettes in public view at 24th Avenue and 21st Street. They were charged with criminal possession of marijuana.

+ Ten Hispanic males, two 17 years old, one 18 years old, one 20 years old, two 21 years old, three 22 years old and one 23 years old, were fighting along 31st Street to 32nd Street and Broadway in public view, causing a public inconvenience. Several of the men attempted to prevent the arrest of some of the others and resisted arrest. They were charged with obstructing governmental administration, resisting arrest and disorderly conduct.

+ Despite signs posted at the entrances and exits stating that the park closes at 9 p.m., two Hispanic men 20 and 22 years old and a 17-yearold Hispanic woman were observed inside Astoria Park at Shore and Ditmars Boulevards after closing. They were charged with criminal trespass.

+ Two Hispanic women 19 and 21 years old and two Hispanic men 20 and 22 years old were found to be in possession of marijuana in public view at Ditmars and Shore Boulevards. They were charged with criminal possession of marijuana.
