114th Pct. Executes 7th Search Warrant of 2006

Two nuisance abatement warrants and the seventh search warrant of 2006 were executed in the 114th Police Precinct under the direct supervision of Deputy Inspector Brian McCarthy, 114th Precinct commanding officer.

On Thursday, March 23, at approximately 9 p.m., New York Auto Body Incorporated at 38-10 22nd St. was closed by the 114th Precinct and the New York City Police Department Legal Bureau in accordance with a Nuisance Abatement Order five people were arrested for illegal auto dismantling, the same offense for which the business, known as a "chop shop" was closed.

"This operation sends a powerful message to other establishments in the neighborhood," McCarthy said. " The execution of this court order positively impacts this problematic index crime of 'stolen vehicles'. The 114th Precinct has improved from being third in the city to 10th and this type of action will continue for the positive trend."

Another nuisance abatement warrant was executed on Wednesday, March 29 at approximately 1 a.m., again under McCarthy's direct supervision. 114th Precinct officers and the Police Department Legal Bureau closed el Forum, 34-19 Steinway St., a chronic quality-of-life location which has failed underage sting operations and which has been issued summonses for disorderly premises on multiple occasions.

"This operation sends a powerful message to other bars in the community," McCarthy said. He added that the precinct officers meet regularly with area bar owners and at those meetings owners are informed that the bars can be closed by court order under nuisance abatement statutes.

The seventh search warrant issued in the 114th Precinct again, under McCarthy's direct supervision, was executed on Sunday, April 2, at approximately 5:30 p.m. at 21-60 46th St., a private house.

Two white males, 31 and 39 years old, who live at the house, were arrested by Police Officer Tice of the 114th Precinct and charged with criminal possession of a weapon in the third degree, unlawful possession of marijuana and unlawful possession of ammunition. Evidence included a switchblade, a machete, two .45-caliber rounds of ammunition and a quantity of marijuana.This enforcement focused upon prior arrest activity of the perpetrators and prior observations made from radio runs. The investigative details were presented to a judge and a search warrant was issued.

"This is the type of thorough professionalism that I advocate-following up on an observation with a court order allowing us to obtain evidence in a manner that presents a solid case," McCarthy declared. 114th Precinct Police Blotter Friday, March 24:

+At 36th Avenue and 30th Street, three Hispanic men, ages 43, 45 and 49, were arrested after they had a verbal altercation with a male victim who they then punched with closed fists and kicked in the back numerous times while he was on the ground. The victim sustained injuries and was in pain. The perpetrators were charged with assault with intent to cause physical injury and harassment.

+A 34-year-old Asian man was arrested at 34-16 Astoria Blvd. and charged with violation of a local law after he was seen with an open container of alcohol in public view.

+A 34-year-old Hispanic man traveling northbound on 29th Street in a grey Honda was seen disobeying a steady red signal at the intersection of 29th Street and Broadway, while swerving. When the car was stopped, the suspect was found to have watery eyes and a strong odor was emanating from his breath. He was charged with driving while intoxicated and disobeying a traffic device.

+While walking home, a man was approached by five males at 48-10 31st Ave. One displayed a knife and demanded all the victim's possessions. A second male punched the victim in the face and the victim fell to the ground. When the victim tried to get up and run away, one perpetrator, a 19year-old black man, held him back, preventing him from running away. The four other unknown males fled the scene; the one suspect remaining was charged with robbery. Sunday, March 26:

+A 30-year-old Asian man was observed by security bringing two bags into a store at 32-27 48th and placing two pairs of jeans into the bags. The perpetrator went to the courtesy desk, exchanged the jeans and then did the same thing again. When he again approached the courtesy desk, he was taken into custody. He was charged with criminal possession of stolen property and petit larceny.

+A 35-year-old Hispanic man was observed lying across a park bench, obstructing the sitting area at 35th Avenue and Steinway Street in violation of a local law. Upon further investigation, there was an active warrant for the defendant.

+Two, 17-year-old, white males, were observed removing a lighter from its package and placing the merchandise in their pockets at 33-01 30th Ave. When the defendants proceeded to pass all points of sale, they were taken into custody and charged with petit larceny. Monday, March 27:

+A complainant states she had just returned home from filing a complaint against a 22-year-old, Hispanic man. She claimed the defendant did proceed to beat her to the ground. The defendant fled the location in his vehicle and a canvass was conducted which resulted in negative results. When an officer returned to the victim's home the defendant was discovered sleeping in his vehicle, parked across from the complainant's home at 25-54 14th Pl. The defendant was charged with burglary, robbery, menacing, assault with the intent to cause physical injury, criminal possession of stolen property and harassment.

+Six males, ages 17, 18, 19 and 20, three Hispanic and two Caucasian were in an eastbound vehicle on Hoyt Avenue at the intersection of 31st Street. One of the six defendants, while operating the motor vehicle, was observed driving erratically. A car stop was conducted, whereupon numerous open, half-full and empty bottles of Corona beer were in public view throughout the vehicle. The defendants claimed to have no ID, yet the officer observed a black wallet on the back seat of vehicle. In an attempt to identify the defendants, the officer searched the wallet and discovered 20 glassine envelopes with cocaine inside. Once taken into custody, a search incidental to a lawful arrest resulted in 2 additional glassine envelopes with cocaine inside a Marlboro cigarette container. The defendants were charged with criminal possession of controlled substance with intent to sell, criminal possession of a controlled substance and drinking alcohol in a motor vehicle while on a highway. Tuesday, March 28:

+At 31-51 21st St., four 15-year-old males punched the complainant in the face and threw him to the ground while he was walking home with a friend. The defendants demanded money, took the victim's cell phone and fled on foot. Complainant claims to know the three black and one Hispanic male. Complainant sustained no injuries. All were charged with robbery.

+A 30-year-old, Hispanic man was observed operating a grey Ford van at 33rd Street and Broadway while not wearing a seatbelt. Acar stop was conducted and the officer observed the vehicle's emission and windshield stickers to be fraudulent and counterfeit due to several missing security features. The driver was charged with possession of a forged instrument, operating a motor vehicle without an inspection certificate and driver not wearing a seatbelt.

+A security officer observed a 41-year-old Hispanic male placing numerous packs of batteries and lamps in his cart who then proceeded to take the cart to the back of the store located at 5010 Northern Blvd. The defendant proceeded to place battery packs in his overcoat pockets and pass all points of sale. Defendant was stopped by security outside the store and charged with criminal possession of stolen property and petit larceny. Wednesday, March 29:

+A 43-year-old black male did attempt to buy a lap top computer at Best Buy, located at 50-01 Northern Blvd., with a fraudulent MasterCard from Southeast Bank. The defendant did produce a fraudulent Virginia driver's license as proof of identification for the credit card in question. The defendant was found to be in possession of three more fraudulent MasterCards from Southeast Bank, Orchard Bank and MBNA Credit Union. The defendant was charged with possession of a forged instrument, forgery and grand larceny.

+At 21st Street and 21st Avenue a complainant states she had been receiving numerous calls on her cell phone from a 29-year-old black male who threatened her every time he called causing her annoyance and alarm. The defendant also followed the complainant to different locations causing her to be in fear of her safety. The defendant was charged with aggravated harassment and harassment in the first and second degree.

+Two 18-year-old Hispanic males were found to be in possession of marijuana in public view at 31-15 14th St. and charged with criminal possession of marijuana.

.+A 16and 17-year-old male Hispanic were observed in Astoria Health Playground located at 31st Road and 14th Street after 9 p.m. and charged with criminal trespass. The signs were publicly posted and stated the park closed at 9 p.m. Thursday, March 30:

+At 34-48 Steinway St. a defendant was observed in possession of and swinging a baseball bat around on a public street placing bystanders in danger causing the public annoyance and alarm. Both defendants, a 25-year-old white male and a 27-year-old Hispanic male, did then proceed to yell profanities and make obscene gestures to the officers. Defendants continued to behave erratically by swinging their arms and pulling away from the officers when being placed under arrest. One of the defendants was found to be in possession of a small bag of white substance in his front pant pocket. Both defendants were charged with menacing, criminal possession of a weapon, resisting arrest and disorderly conduct.

+A 47-year-old black male was observed disobeying a stop sign at 27th Street and Hoyt Avenue South, and a car stop was conducted. The defendant was unable to present any of the documents requested by the officer and upon further investigation the vehicle registration was found to be suspended due to invalid proof of insurance. A DMV check revealed the defendant to be operating a vehicle with a suspended license. The defendant was charged with aggravated unlicensed operator, produced false insurance card, unlicensed operator, unregistered vehicle and failure to stop at stop sign.

+A 54-year-old Hispanic man did punch a victim in the back with a closed fist, choke and threaten to kill her at 25-23 33rd St. The victim was in substantial pain, was annoyed and in fear of her safety. The defendant has been charged with assault with the intent to cause physical injury and harassment.

+At the intersection of Astoria Boulevard and Crescent Street a 40-year-old Hispanic man was observed traveling westbound on Astoria Boulevard making a left turn onto Crescent Street at approximately 9:15 a.m. Two DOT signs are posted at that location stating "No Left Turn" between the hours of 7 and 10 a.m. Acar stop was conducted and a DMV check revealed the defendant to be operating a vehicle with a suspended license. He was charged with aggravated unlicensed operator, unlicensed operator and failure to obey a traffic device. Friday, March 31:

+A complainant/victim was engaged in a verbal dispute with a 44-year-old white man at 33rd Street and Broadway [over a parking space] when the defendant took out a black pipe and threatened the complainant. The complainant was placed in fear of his safety and was caused annoyance and alarm. The defendant was charged with menacing, criminal possession of a weapon and harassment.

+A 19-year-old black male was observed traveling westbound on 40th Avenue at 23rd Street when he failed to come to a complete stop at the stop sign. Upon car stop, defendant was unable to produce a valid insurance card and a DMV check revealed the defendant to be operating a vehicle with a suspended license. He was charged with criminal possession of a controlled substance, aggravated unlicensed operator, failure to produce a valid insurance card and failure to obey a stop sign.

+A 38-year-old Hispanic man was following female juveniles inside a commercial establishment at 48-10 31st Ave. and was also seen on school property. The complainant stated that the defendant took numerous photos of her and other juvenile females causing fear of material harm and also causing emotional stress. The defendant was charged with stalking, criminal trespass, harassment, and acting in a manner to injure a child.
